5 Ways SCOTUS Lied about Abortion | Mark Harrington

Reading tea leaves is risky business. But that is what many Supreme Court observers are doing in the wake of the oral arguments in Dobbs v. Jackson Women’s health Organization case.

So, what is the case?

Dobbs v. Jackson is a 15-week abortion ban from Mississippi. Dobbs is the most consequential case since Planned Parenthood v. Casey in which the SCOTUS affirmed Roe’s central findings. At the center of the argument is the viability standard. Viability is now believed to be between at 21-24 weeks, but it is constantly changing and, hence, is not a workable framework.

As the justices of the Supreme Court respond to oral arguments for a case that directly challenges Roe v. Wade, they peddled 5 falsehoods about legalized abortion on demand and constitutional jurisprudence that need addressed.

Would overturning a decision that was admittedly wrong threaten the court’s legitimacy, or help to restore it?

Is the fact that human life begins at conception a mere arbitrary religious viewpoint?

On abortion policy, America has more in common with the North Korea and China regimes than with our friends Britain and France. If the phrase “you’re only as good as the company you keep” rings true for nations, perhaps too good, our nation must finally scrap Roe v. Wade.

Roadmap for a Post-Roe America | Mark Harrington

According to the Center for Reproductive Rights (CRR), if Roe v. Wade were overturned, abortion would be illegal in half of the U.S. states and all the U.S. territories.

If Roe fell:
• 22 states have laws that could be used to restrict the legal status of abortion.
• 8 states would retain their unenforced, pre-Roe abortion bans.
• 11 states have post-Roe laws to ban all or nearly all abortions that would be triggered if Roe were overturned.
• 9 states have post-Roe restrictions that are currently blocked by courts but could be brought back into effect with a court order in Roe’s absence.

Based on the CRR’s analysis, if the Supreme Court were to overturn Roe, abortion would remain legal in twenty-one states.

There are twenty-four states—nearly all of which are situated in the central and southern parts of the country that could immediately prohibit abortion entirely. These states are capable of reviving old abortion bans or the enactment of new ones, and none of them has legal protections for abortion.

Therefore, if Roe falls, states would be divided into abortion deserts, where it would be illegal to access care, and abortion havens, where care would continue to be available.
